A college or university can forfeit the admission fee of a candidate who wishes to withdraw his admission from the institute but does not apply for refund before the next counselling for the same course, a district consumer forum has held.
A District Consumer Disputes Redressal Forum bench presided by Babu Lal dismissed the complaint filed by Ravi Kant Sharma, who sought refund of Rs 58,000, which he had paid as fee while taking admission in a MCA course in Guru Gobind Singh Indraprastha University in 2007.
"Since the candidate did not withdraw admission by the prescribed date before the second counselling, the University was not in a position to offer his seat to any other deserving candidate in the next counselling after which no admission could have been effected," the bench said.
Sharma, a month after taking the admission had decided to withdraw his admission but he applied for a refund of fees, 12 days after the second counselling. He demanded refund of fee contending that the seat had been filled up later.
